WRONG!! all the sudden all 5 bouncers jump my shit. now 2 of them are off duty cops. well i dont remember anything after this but froim the reports of witnesses they stompped my head into the ground and i got up and broke 1 guys nose and kneed a guy so hard in the nuts he was sent to the hospital. well they continued beating my ass and when thery got done they threw me into on comming traffic. thank god they werent driving fast or i woulda been killed. sad thing is one of my now former frinds just stood there and watched all this happen. fucked up if you ask me. now i got this lawer (biggest in birmingham) and we are gunna sue the shit outa the club. now the questiuon is do you think i will get anything out of it. oh by the way i went to the hospital and got 4 broke ribs 3 hair line fractures a slight concution and cut all the hell not to mention the bruses. so someone tell me if i should even pursue this cuz i was drunk but i beleive they used extreme force. now all i can say is DAMN THAT HURT!!! :wallbang: :wallbang: :wallbang:
Re: HARCORE STOMPING!
regardless of how much you had to drink. Being that they're bouncers they have no right to beat you ass like they did.
DO NOT sue the bouncers alone, sue the club as well, make damn sure this thing goes to a jury, because that is prolly the only way this thing will get settled.
But then, what the hell do I know, I'm justa Canuck EH! :yeah: :yeah: :yeah:

Unless you can subpoena some SOBER witnesses, it's your word against theres. And they are officers of the law, off-duty or not. And they were sober. Did I mention you're going to go up against sober cops? But go for it anyway, what do you have to lose besides court fees. And what exactly are you planning to sue for? If it's a ridiculous amount of money, I would say no because it's purely immoral and unethical. But if it's enough to cover your hospital expenses and any pay you would lose from missing work while recuperating, then go ahead by all means. Of course you have no idea what it is that you did that made them throw your ass out in the first place. It could have been something pretty illegal and beating your ass was letting you off easy. In that case, you'd be taking yourself to court.
I had 1 broken rib a while back from playing soccer and goddamit, it even hurt to breathe. So with four ris, forget even moving for a while. Unless you've got some mad narcotics for the pain.

You aint felt pain, until you break your back. I have 3 fracture vertabra, and one broken. It happened a very long time ago, yet the pain never goes away. When I'm over exerting myself, then I end up having to wear a back brace for extended periods of time.
At least ribs heal.

You're lucky you're alive and mobile... One of the students I treat in a school that I work with was run over by his Uncle accidentaly when he was about 3... his back was broken and now he's completely paralyzed from the neck down.

I was lucky to not have severed the spinal cord, maybe.
If I had I wouldn't be in pain 24/7, as a result I have an extremely high pain threshold.
Back to the topic, if it was me I would sue the club for pain and suffering, and have the staff charge with assult and battery, and the use of undue force.
Once you are outside the club, they had no ground whats so ever to assult you, as you were off the premisis. Being that they're off duty cops is no excuse, the cops should know better, and should lose their jobs as a result.

Well yeah in a perfect world maybe, but guess what, there is a little something called politics involved. The fact that they're cops, unless one of the city's brass has it in for them, means the chips are stacked in their favor. It's bullshit, but it's the way it is. Cronyism runs rampant in the US.
Hell, in the area of Texas where I live, there's a huge drought going on, and our water for watering the lawn is being rationed according to the street you live on. My next door neighbor's son is a local politician and is on the Public Utlities Board, so her sprinkler is on 24/7 to beat the... let's see what temperature it is right now... 106-degree days. My dad works for the state EPA, so we can water whenever we want as well; Even though the city has "water police" that go around ticketing people with their sprinklers on on the wrong day, there's actually a list put together of houses to not fine. The city officials made an adjustment to the water-billing software at city hall so that when they don't pay their water bills, no red-flag is put up, and their water never gets turned off.
Welcome to America... Land of the Free, if you know the right people.

This might be so, but there is always a way to see justice done, using the media is a big one. BUT also sueing the club will put some serious heat on the club, regardless if he pursues the cops, and he stated that not all of the bouncers were cops.
All he has to do is lay a general lawsuit against the club, and report the "bouncers" as an association of guilty parties in a crime causing bodily harm. Which isn't directly blaming anyone person, but the group as a whole. IF his lawyer is good enough, there will be an internal review of the actions that were taken by "off duty" cops, and then the lawsuit against the club is easy enough.
